AN ORDINANCE AMENDING CHAPTER 50 OF THE DULUTH CITY CODE 1959, AS AMENDED, ZONING DISTRICT MAP NO. 27 AS CONTAINED IN THE APPENDIX TO CHAPTER 50, TO PROVIDE FOR THE RECLASSIFICATION FROM S, SUBURBAN, TO C-5, PLANNED COMMERCIAL DISTRICT, PROPERTY LOCATED ON THE NORTH SIDE OF ARROWHEAD ROAD APPROXIMATELY 1,360 FEET EAST OF THE INTERSECTION OF HAINES ROAD AND ARROWHEAD ROAD (FRANK HOLAPPA).

The city of Duluth does ordain:

     Section 1. That Plate No. 27 of the zoning district map as contained in the Appendix to Chapter 50 of the Duluth City Code, 1959, is amended to read as follows:

     Section 2. That this ordinance shall take effect and be in force 30 days from and after its passage and publication.


STATEMENT OF PURPOSE: This ordinance is a counter action to Resolution 07-0745 and approves the petition for a zoning change, from S to C-5 for property located located on the north side of Arrowhead Road approximately 1,360 feet east of the intersection of Haines Road and Arrowhead Road. Applicant states the purpose of this request is to make this property available for commercial development with adjacent land to the west to create a coordinated commercial development.


The Duluth city planning commission voted to APPROVE this zoning change following a public hearing held November 14, 2007 10-1-1 vote.


In recommending approval of the zoning change the planning commission made the following findings of fact:

1. The rezoning follows the comprehensive plan recommendations for the area.

2. The rezoning is compatible with the zoning to the west which is C-5.

3. C-5 requires the preparation of an approved development plan.
