RESOLUTION AUTHORIZING JOINT POWERS AGREEMENT WITH MULTIPLE PARTIES ESTABLISHING THE MINNEAPOLIS-DULUTH / SUPERIOR PASSENGER RAIL ALLIANCE.

CITY PROPOSAL:

     RESOLVED, that the proper city officials are hereby authorized to enter into an agreement, a copy of which is on file in the office of the city clerk as Public Document No. ______________ with the Anoka county regional railroad authority, the Hennepin county regional railroad authority, the Isanti county regional railroad authority, the Pine county regional railroad authority, the St. Louis-Lake county regional railroad authority, the city of Minneapolis, and Douglas County, Wisconsin, creating the Minneapolis-Duluth/Superior passenger rail alliance to plan, analyze and facilitate development of a intercity passenger and freight rail service between Duluth/Superior and Minneapolis.

STATEMENT OF PURPOSE:  The purpose of this resolution is to approve a joint powers agreement providing for planning, analysis and implementation of passenger rail service between the Twin Ports and Minneapolis. The member agencies participating in this agreement will represent the affected governmental units along the rail corridor.


Each governmental unit represented on the board will have one member and will generally have one vote on the joint powers board except as it pertains to financial matters, where a number of protections are built into the structure. First, each member entity will be asked to contribute to costs of the alliance on a formula to be approved by the board each year. However, no member will be required to contribute to those costs unless the member’s governing board has approved the organization’s annual budget and its share of the organization’s costs. In addition, if the organization proposed an expenditure in excess of $20,000, the members will have voting power proportional to its annual share of contributions to the budget for that year.


Any member may terminate its involvement with the organization by resolution of its governing body on 90 days notice.
