RESOLUTION TO SELL ONE HALF ACRE OF CITY PARK LAND TO WHITE PINE DEVELOPMENT WITHOUT BIDS BECAUSE THE SALE FURTHERS A DULUTH ECONOMIC DEVELOPMENT AUTHORITY PLAN FOR DEVELOPMENT OF THE AREA.

CITY PROPOSAL:

     RESOLVED, that the city council has determined it is in the public interest to sell the property described below to White Pine Development, without bids, as allowed by Section 2-177, because the sale will further a plan for development of the area in accordance with a land sale agreement that the purchaser has entered into with the Duluth economic development authority (DEDA) whereby the purchaser will incorporate the property into a housing development that will result in approximately 23 building lots and at least 70 acres of open space, which is congruent with the comprehensive land use plan legally described as: Lots 8 through 13 inclusive, all in Block 3, Lake View Manor Division (FN 07159).


PLANNING


STATEMENT OF PURPOSE:  This resolution establishes the reason for sale of a half acre park in Lake View Manor Division to White Pine Development as is required by Section 2-177. This resolution is a companion to Ordinance 08-008-O.


The sale will further a DEDA plan for development of the area which will include the development of roads and utilities for approximately 23 home sites. DEDA’s role in the project is only to acquire the surrounding 31 acres of tax forfeited land on behalf of the developer so that he may combine it with 114 acres already owned by the developer to create a large enough site to facilitate the housing development in a manner consistent with the comprehensive plan.


There is no public subsidy of any kind in this project and the developer is paying the appraised market value for all public land.
