BE IT RESOLVED, that the city council of the city of Duluth approves the transfer of the following on sale intoxicating liquor license and issues an on sale Sunday license for the period ending August 31, 2008, subject to departmental approvals and the payment of sales and property taxes, to:
Zooch of Duluth, LLC (Teatro Zuccone, Café Zed, Zinema), 222 East Superior Street, with Keir Johnson, owner, transferred from JM & JK, Inc. (John’s Red Lion Bar), 222 East Superior Street.

Alcohol, gambling and tobacco commission discussion of 2/6/2008: Keir Johnson was present on behalf of the application. Mr. Johnson explained that he will be the manager of Zooch of Duluth which is a subsidiary of the Zeppa Foundation. He continued saying that the foundation owns the building at 222 East Superior Street and have bought the building the Red Lion was in at 220 East Superior Street and will be remodeling both buildings into one single building. Mr. Johnson went on to say initially they are going to use the license in the concession area the Renegade Comedy Theatre is currently using for their 3.2 beer license, but they will not be renewing that license in May. He continued explaining they intend to expand their operation with a movie theater on the Michigan Street level and a café in the front of the building on the Superior Street level. To the commission’s question, Mr. Johnson replied that they will be contracting with Craig Samborski to run the day to day operation. Assistant city attorney Lutterman replied that city code requires anyone serving alcohol has to be an employee of the liquor licensee. To further questioning, Mr. Johnson replied that when the movie theater opens in the lower level, they would like to serve alcohol in the lower concession area, so their application is requesting both the Superior Street level and Michigan Street level become their licensed premises. To questioning from the commission, Mr. Johnson replied that they plan on being on Sunday and initially will only have the concession area open that will have candy and popcorn. Ms. Lutterman replied that with a Sunday license the State law requires that meals must be prepared on site which would require a health department license. She explained that having a pizza oven and a menu of frozen pizzas would fulfill that requirement. Mr. Johnson explained that the name of the facility will be Zeitgeist Arts, the movie theater will be called Zinema, the café will be Café Zed, and the new name for the Renegade Comedy Theatre will be Teatro Zuccone. There being no further discussion, Mr. Karki moved that THE APPLICATION OF ZOOCH OF DULUTH, LLC, 222 EAST SUPERIOR STREET, FOR TRANSFER OF THE ON SALE INTOXICATING LIQUOR LICENSE AND APPLICATION FOR AN ON SALE SUNDAY LICENSE FOR THE PERIOD ENDING AUGUST 31, 2008, WITH KEIR JOHNSON, OWNER, TRANSFERRED FROM JM & JK, INC. (JOHN’S RED LION BAR), 220 EAST SUPERIOR STREET, BE APPROVED AND THE SAME BE RECOMMENDED TO THE CITY COUNCIL FOR APPROVAL. Mr. Hanson seconded the motion and it was unanimously approved.
