INTERGOVERNMENTAL RELATIONS COMMITTEE

The city council finds as follows:
(a) Henry L. Banks is a commissioner serving on the Duluth planning commission in a term ending December 31, 2009;
(b) Mr. Banks is proposed for appointment to the community development committee (Resolution No. 08-0226);
(c) At the council’s agenda session on March 20, 2008, Councilor Fedora, not being acquainted with Mr. Banks, asked why a copy of his application was not, as with others similarly situated, furnished to the council, and asked that it be provided to them before a vote was taken. Councilor Krause agreed;
(d) Mr. Banks responded with an e-mail, on file with the clerk as Public Document No. __________, which falsely accused the two councilors of intentional racial discrimination, condemned the whole community as racist, and used inflammatory and offensive language that any reasonable person should know is inappropriate, in violation of any standard of civility, deleterious to reasonable discussion, and unsuitable for use by a public official (planning commissioner) in conduct of the public business.
NOW, THEREFORE, BE IT RESOLVED, that the city council, based upon the findings above that Mr. Banks has displayed, in the course of his activities as an appointed public official, poor judgment and the use of inflammatory, uncivil speech and false accusations (which behavior cannot be tolerated), requests that the mayor, acting pursuant to Section 27 of the Charter, initiate proceedings to remove Henry L. Banks from the planning commission.
STATEMENT OF PURPOSE: This resolution requests the removal of a member of the planning commission for cause.
