RESOLUTION APPROVING THE TRANSFER OF THE ON SALE INTOXICATING LIQUOR LICENSE AND ON SALE SUNDAY LICENSE FROM ZOOCH OF DULUTH, LLC (TEATRO ZUCCONE), 222 EAST SUPERIOR STREET TO ZEITGEIST ARTS, LLC (ZEITGEIST ARTS), SAME ADDRESS.

CITY PROPOSAL:

     BE IT RESOLVED, that the city council of the city of Duluth hereby approves the transfer of the on sale intoxicating liquor license and on sale Sunday license for the period ending August 31, 2008, subject to departmental approvals and the payment of sales and property taxes:

           Zeitgeist Arts, LLC (Zeitgeist Arts), 222 East Superior Street, transferred from Zooch of Duluth, LLC (Teatro Zuccone), same address.

Alcohol, gambling and tobacco commission discussion of 5/7/2008: Kat Eldred was present on behalf of the application. Ms. Eldred explained that Zeitgeist Arts and Zooch of Duluth are subsidiaries of the Zeppa Foundation, and reviewed in February they originally transferred the Red Lion license to Zooch of Duluth, LLC, which was set up to be a holding tank for the liquor license. She continued saying they are now requesting to transfer the license to Zeitgeist. Ms. Lutterman explained that the transfer is occurring to meet the requirement that the employees serving the alcohol are employees of the corporation holding the liquor license which is Zeitgeist Arts. To questioning from the commission, Ms. Eldred replied they hope to have their license in place by June for the theatre which was previously Renegade Comedy Theatre. There being no further discussion, Mr. Hanson moved THAT THE APPLICATION OF ZEITGEIST ARTS, LLC (ZEITGEIST ARTS), 222 EAST SUPERIOR STREET, FOR TRANSFER OF THE ON SALE INTOXICATING LIQUOR LICENSE FOR THE PERIOD ENDING AUGUST 31, 2008, TRANSFERRED FROM ZOOCH OF DULUTH, LLC (TEATRO ZUCCONE), SAME ADDRESS, BE APPROVED AND THE SAME BE RECOMMENDED TO THE CITY COUNCIL FOR APPROVAL.
