RESOLUTION AUTHORIZING AN AMENDMENT TO THE AGREEMENT WITH SECRET SERVICE ENTERTAINMENT, LLC, THE DULUTH ECONOMIC DEVELOPMENT AUTHORITY AND LAKE SUPERIOR CENTER AUTHORITY ADDRESSING PARKING ISSUES RELATED TO SPECIAL EVENTS HELD AT BAYFRONT FESTIVAL PARK.

CITY PROPOSAL:

     RESOLVED, that the proper city officials are authorized to enter into an amendment to the agreement regarding special events held at Bayfront Festival Park, substantially in the form of that on file in the office of the City Clerk as Public Document No. ____________, with Secret Service Entertainment, LLC, (contractor), the Duluth economic development authority (DEDA) and Lake Superior Center authority (LSCA) which amendment clarifies certain issues regarding parking on the city-owned and DEDA-owned lots near Bayfront.

STATEMENT OF PURPOSE:  The city owns Parking Lot A and DEDA owns Parking Lots B, C and D shown on Exhibit A of the agreement. This amendment addresses issues that have arisen regarding parking during special events at Bayfront Festival Park.


Under the amendment, parking during certain city events such as the 9/11 Ceremony will be free. For Fourth Fest, the Explorers will receive 75 percent of the net parking revenues and DEDA and the city will receive 25 percent of the net parking revenues for their respective lots. For all other events produced by the contractor, the contractor will manage the parking and revenues will be split 50 percent to the contractor and 50 percent to the city and DEDA for their respective lots.


The Reggae Festival will be managing the parking for its event and the gross parking revenues will be split 50 percent to Reggae and 50 percent to the city and DEDA for their respective lots. For all other events produced by a promoter where there is a charge for the event, the contractor will be responsible for managing the parking and the gross parking revenues will be split 50 percent to the contractor and 50 percent to the city and DEDA for their respective lots.


For free events produced by a promoter where 200 or more vehicles are expected to park, the contractor will be responsible for managing the parking and the gross parking revenues will be split 50 percent to the contractor and 50 percent to the city and DEDA for their respective lots. Where less than 200 vehicles are expected at a free event, the contractor will not be providing parking services.
