RESOLVED, that the city council hereby requests the Charter commission to recommend an amendment of Chapter IX of the City Charter, which proposed ordinance is on file in the office of the city clerk as Public Document No. ____________.
STATEMENT OF PURPOSE: The purpose of this resolution is to request that the Charter commission recommend amending and simplifying the City Charter and to create more flexibility for the city and the city council in addressing the city’s process for assessing for local improvements.
The present City Charter provisions governing assessments are very detailed and contain provisions which handicap the council in its ability to adapt the assessment process to changing conditions including petition percentages, limitations on council-authorized assessments and fees specified in dollar amounts which are no longer realistic. In addition, the Charter mandates a special assessment board procedure which creates an additional step that the public has to go through to petition a project.
The proposed amendments would reduce the amount of “process” written into the Charter and would allow the council to address those issues by ordinance, thus making it easier to make adjustments to the process to respond to changing times and changing conditions. It also clarifies the ability to the council to authorize assessments for maintenance of infrastructure improvements such as street maintenance and improvements to utility service lines.
