RESOLUTION DENYING A REQUEST TO AMEND CHAPTER 50 OF THE DULUTH CITY CODE, 1959, AS AMENDED, ZONING DISTRICT MAP NO. 28 AS CONTAINED IN THE APPENDIX TO CHAPTER 50, TO PROVIDE FOR THE RECLASSIFICATION FROM R-1-C, ONE FAMILY RESIDENTIAL, TO C-5, PLANNED COMMERCIAL DEVELOPMENT, PROPERTY LOCATED AT 114 WEST MYRTLE STREET, BETWEEN BASSWOOD AVENUE AND HUGO AVENUE (STEVE LINDBERG).

CITY PROPOSAL:

     The city council denies a petition submitted by Steve Lindberg, to rezone the subject property located at 114 West Myrtle Street, between Hugo Avenue and Basswood Avenue, in Duluth Heights, legally described as Lots 4 and 5, Block 31, Duluth Heights Sixth Division, from R-1-c, residential, to C-5, planned commercial development, based on the following findings [to be determined by the city council]:

STATEMENT OF PURPOSE: This resolution is a counter action to Ordinance 08-050-O and denies a petition by Steve Lindberg, to rezone from  R-1-c to C-5, property located at 114 West Myrtle Street, legally described as Lots 4 and 5, Block 31, Duluth Heights Sixth Division, between Basswood Avenue and Hugo Avenue, in the Duluth Heights Neighborhood. Applicant states the purpose of this request is to provide property for resale for commercial use.


The Duluth city planning commission voted to APPROVE this zoning change following a public hearing held June 10, 2008 by a unanimous vote 8-0, based on the following findings:

     1.   Conforms to the recently adopted comprehensive plan.

     2.   Rezoning is compatible with zoning to the southeast and south.
