RESOLUTION DENYING A REQUEST TO AMEND CHAPTER 50 OF THE DULUTH CITY CODE, 1959, AS AMENDED, ZONING DISTRICT MAP NO. 40 AS CONTAINED IN THE APPENDIX TO CHAPTER 50, TO PROVIDE FOR THE RECLASSIFICATION FROM S, SUBURBAN, TO R-1-B, ONE FAMILY RESIDENTIAL, FOR PROPERTY LOCATED AT 2516 WOODLAND AVENUE (FOREST HILL CEMETERY).

CITY PROPOSAL:

     RESOLVED, that the city council denies a petition submitted by Forest Hill Cemetery to rezone the subject property located at 2516 Woodland Avenue legally described as Lots 6 to 14, Block 4, Woodland Park Sixth Division, from S, suburban, to R-1-b, one family residential, based on the following findings [to be determined by the city council]:

STATEMENT OF PURPOSE:  This resolution denies the zoning from S to R-1-b for property located on the east side of Woodland Avenue just north of Carlisle Avenue. Forest Hill Cemetery wishes to sell the caretaker home as they no longer have an on-site caretaker, do not want the cost of maintaining the building, and wish to improve their cash flow.


Following the public hearing on July 8, 2008, the Duluth city planning commission voted 11 yes, zero no, and one abstaining to recommend this request. Companion action to approve this request is found in Ordinance 08-053-O.
