RESOLUTION AUTHORIZING A LAKEWALK TRAIL LICENSE AGREEMENT WITH THE ST. LOUIS AND LAKE COUNTIES REGIONAL RAILROAD AUTHORITY FOR OPERATION AND MAINTENANCE OF THE LAKEWALK TRAIL FROM 36TH AVENUE EAST TO 47TH AVENUE EAST.

CITY PROPOSAL:

     RESOLVED, that the proper city officials are authorized to enter into an agreement substantially in the form of that on file in the office of the city clerk as Public Document No. ____________ with the St. Louis and Lake Counties Regional Railroad Authority for the construction and operation of the Lakewalk recreational trail from 36th Avenue East to 47th Avenue East at nominal cost.


STATEMENT OF PURPOSE:  This resolution will authorize an agreement with the St. Louis and Lake Counties Regional Railroad Authority allowing the city to utilize a portion of the railroad right-of-way for the construction and operation of the Lakewalk recreational trail.


The authority controls the railroad easement and operates on the trackage that runs along the lakeshore to Lemon Drop Hill and then crosses I-35 and runs along the north side of London Road out to 60th Avenue East and beyond to Two Harbors and the Iron Range. The authority uses the trackage primarily for tourist train facilities, but also allows some freight shipments to use the corridor when needed.


The city’s Lakewalk trail currently runs from the ship canal to 36th Avenue East, and the city has received state and federal funding which will allow extension of the trail to 47th Avenue East, with a commitment in future years for subsequent extensions to Brighton Beach.


The present plan is to use railroad right-of-way to provide the pathway necessary for the trail, with is under the control of the authority. By this agreement the authority will grant the city a 25-year license (subject to termination by the authority) to construct and maintain the trail on the right-of-way. Storm sewer work, consisting of culvert crossings at various locations across the path, is also authorized. The cost will be $500 for legal fees for preparation of the license agreement and $1 per year for 25 years. City project no. 0580TR.
