AN ORDINANCE AMENDING CHAPTER 50 OF THE DULUTH CITY CODE, 1959, AS AMENDED, ZONING DISTRICT MAP NO. 28 AS CONTAINED IN THE APPENDIX TO CHAPTER 50, TO PROVIDE FOR THE RECLASSIFICATION FROM R-1-C, ONE FAMILY RESIDENTIAL, TO C-5, PLANNED COMMERCIAL DEVELOPMENT, PROPERTY LOCATED AT 114 WEST MYRTLE STREET, BETWEEN BASSWOOD AVENUE AND HUGO AVENUE (STEVE LINDBERG).

CITY PROPOSAL:

The city of Duluth does ordain:

     Section 1. That Lots 4 and 5, Block 31, Duluth Heights Sixth Division, be reclassified from R-1-c, residential, to C-5, commercial, and that Plate No. 28 of the zoning district map as contained in the Appendix to Chapter 50 of the Duluth City Code, 1959, is amended to read as follows:

     Section 2. That this ordinance shall take effect and be in force 30 days from and after its passage and publication.

STATEMENT OF PURPOSE: This ordinance should have no effect on the tax base. This zoning ordinance amendment provides a zoning change, from R-1-c, residential to C-5, commercial, two lots legally described as Lots 4 and 5, Block 31, Duluth Heights Sixth Division. These lots are currently vacant and are located at 114 West Myrtle Street, between Basswood Avenue and Hugo Avenue. Applicant states that, “The reason for the request is for property resale. The lots previously had a house on them and would be more valuable zoned commercial because three of the six properties around this area are currently zoned commercial. It would be impossible to sell or rebuild as a residential lot due to the size and location of the lots.”


The Duluth city planning commission unanimously approved this zoning change following a public hearing held on June 10, 2008.


In approving the zoning change the commission made the following findings of fact in support of the change:

     1.   The rezoning is in concurrence with surrounding area uses to the southeast and south.

     2.   The request is in compliance with Duluth’s C-5 zoning regulations.

     3.   The rezoning would be in the public’s interest.
